Terms for watching from the fell

1. Who keeps the observatory

fellsideobservatory.com (“Fellside Observatory”, “we”, “us”) is operated by the operator of fellsideobservatory.com. These terms govern your use of the dome and its worlds, and using the site means you accept them.

2. Who may climb to the dome

Fellside Observatory is only for people aged 18 or over. Climbing to the dome, which is using the site, confirms that you are 18 or over.

3. Virtual coins at the observatory

• Each world on the fell is played with virtual coins that Ermyn provides free of charge.
• The observatory’s coins have no monetary value; they are not money, credit or property.
• Coins from the dome may not be purchased, sold, withdrawn, transferred or exchanged for money, goods, services or prizes. In-app purchases do not exist here.
• There is no prize of real-world value on offer, on the fell or off it.
• Coins, levels and features may be adjusted or reset by the observatory at any time.

4. The observatory offers no real-money gambling

Fellside Observatory neither offers nor promotes real-money gambling, and carries no links to gambling operators anywhere on the fell.

5. Your page in the observing book

• Shutterwheel Midnight and Spatebeck Arch need a free account. Ermyn keeps one page per person in her book, and a page is not to be shared.
• Your password is yours alone. Tell the dome without delay if anyone else has used your account.
• Delete your account whenever you wish from your account page. Your page is torn out immediately and permanently.
• The observatory may suspend an account that is used to disrupt the site, or that it thinks belongs to a person under 18.
• Coins, levels and missions are attached to the account and are not your property; the observatory may reset them.

6. Conduct under the dome

Do not try to disrupt the dome, run automated tools against it, put coins up for trade, or allow anyone under 18 to use it.

7. Clear skies not guaranteed: availability and liability

The observatory comes “as is”, and we may change or withdraw any part of it, as cloud can close any night’s watch. A malfunction voids all plays and pays. Nothing here limits any liability that cannot be limited by law, and your statutory rights are not affected.

English and Welsh law governs these terms of the dome.
